Regulation and commencement

These general terms and conditions of contract govern the legal relationship between you and the Official Swiss Snowsports School Leukerbad (hereinafter referred to as SSSSL).

The contract between you and SSSSL starts from the date of unconditional acceptance of your registration. From that point on, the rights and obligations arising from the contract (including these general terms and conditions of contract) apply to you and to SSSSL. If you also register other customers with SSSSL, then you are responsible for their contractual obligations (in particular payment) in addition to your own.

Services and prices

Our services are specified in our brochure and on our website. If you have special requests, these must be agreed with the SSSSL administration.

You can find information on lesson and course prices in our brochure or on our website. Prices are per person, unless otherwise specified, and are given in Swiss francs (CHF). For payments in euros, an exchange rate set by SSSSL and based on current exchange rates will apply.

SSSSL expressly reserves the right to change brochure content, service descriptions and prices listed in the brochure and online. If SSSSL makes such changes, it will inform you of this before concluding the contract.

Prices do not cover the cost of using the ski lifts.

Prices do not include VAT, as SSSSL is not subject to VAT.

Registration

We advise you to register as early as possible so that we can guarantee delivery of the service you require.

Payment

Payment must be made immediately after a contract has been concluded. The SSSSL office accepts cash (Swiss francs and euros), Reka Checks, EC-Direct cards, PostFinance cards, Reka cards, as well as Eurocard/Mastercard and Visa.

Conditions of cancellation

If you wish to cancel your registration, you must do so by contacting the SSSSL head office (Kurparkstrasse 5, 3954 Leukerbad, Switzerland / info@skischule-leukerbad.ch). The following cancellation costs apply:

Up to 30 days before the lesson/course: 10%

29 – 10 days before: 50%

9 – 1 days before: 80% (up to 6 p.m. on the day before the lesson)

If you cancel less than a day before, we will unfortunately have to charge you the full price.

Refunds

Cases of force majeure (e.g. restrictions due to bad weather, storm, avalanche risks,….), early departure, illness, etc. do not entitle you to a refund or any kind or a compensation. The insurance PassProtect from the insurance company SOLID is included, in all group and private lessons of the SSSSL rates. With this insurance, the following services: ski school lessons, ski pass Torrent/Snowpark Sportarena as well as ski rental will be refunded (see details) in case of illness (medical certificate needed), accident or closed facilities. Refunds are to be reclaimed directly from the company SOLID Insurance. If you arrive late to a lesson, the lesson will still end at the agreed time. You are not entitled to any compensation for the time lost. Refunds are either made in cash or credited to your debit or credit card, depending on how you paid for the services.

Disclaimer

SSSSL does not assume any liability for accidents that happen before, during or after one of its lessons or events. You are responsible for arranging accident and liability insurance. SSSSL recommends that you also take out travel accident insurance, travel health insurance and holiday cancellation insurance.

Group lessons/courses

If a group lesson or course fails to attract the minimum number of participants, SSSSL reserves the right to merge groups, cancel at short notice, or offer you an alternative (which may incur a surcharge).

Course cards and confirmation

Cards are only valid on the dates displayed on them. Cards are issued to individuals and are non-transferable.

Online content

SSSSL takes no responsibility for the accuracy, completeness or quality of the information provided. In the absence of proof of malicious intent or gross negligence on the part of SSSSL, the SSSSL accepts no liability for claims against it relating to material or immaterial damages, to the use or non-use of the information provided, or to the use of erroneous or incomplete information

All offers are non-binding and subject to change. SSSSL expressly reserves the right to amend, supplement or delete parts or all of the pages and to cease publication temporarily or permanently without notice.

References and links

In cases of direct or indirect references to external websites (“links”) for which SSSSL is not responsible, SSSSL is only obliged to accept liability in the case that a site contains unlawful material if SSSSL was aware of this content and had the technical means to prevent its use and could be reasonably expected to intervene.

SSSSL herewith expressly declares that no illegal content could be detected on the linked sites when the links were created. SSSSL has no influence on the current and future design, contents or authorship of the linked sites. Hence, SSSSL expressly distances itself from all of the content on all of the linked sites that has been changed since the link was created. This applies to all of the links and references on SSSSL’s website and to entries by external parties in the guest books, discussion forums and mailing lists created by SSSSL.

The author of the linked site – and not the company that merely provides a link to the publication in question – bears sole liability for illegal, erroneous or incomplete content and particularly for damages arising from the use or non-use of such information.

Copyright and trademark law

SSSSL endeavours to respect all copyright pertaining to the graphics, audio-visual material and texts that it uses in its publications. It makes every effort to use graphics, audio-visual material and texts that it produces itself, or to use graphics, audio-visual material and texts that are available in the public domain.

All brands and trademarks that are mentioned on SSSSL’s website and may be protected by third parties are fully subject to the provisions of the applicable trademark law and to the property rights of the registered owner in question. The mere mention of a trademarked brand does not imply that this trademark is not protected by third-party rights.

The copyright for published material produced by SSSSL itself remains solely with the author of the pages in question. The reproduction or use of such graphics, audio-visual material and texts in other electronic or printed publications shall only be permitted with the express consent of SSSSL.

Complaints

Please contact the school administration directly if the services provided by SSSSL fail to reflect those laid down in the contractual agreement, if you are not happy with the type of instruction being given, and if you are unable to reach an agreement with the instructor. Complaints should be made in writing, dated and addressed to SSSSL. They should include a description of the incident and the names of the persons involved.

Applicable law and place of jurisdiction

Only Swiss law applies. The place of jurisdiction is Leukerbad in the canton of Valais.
